Terms of Service

These Terms of Service (“Terms”) govern your access to this website and any engagement of testing, audit, or related services (the “Services”) offered by Outboard QA, a service of Spin Zone Creations LLC(“we,” “us,” or “our”). By visiting this site, submitting an inquiry, or engaging our Services, you (“you” or the “client”) agree to these Terms. If you are agreeing on behalf of a company or other entity, you represent that you have the authority to bind that entity.
1. Description of services
Outboard QA provides independent testing and UX audit services for websites, web apps, and software, offered either as a one-time audit or as an ongoing monthly QA Partner subscription, as described on our pricing page. Deliverables are advisory in nature: we identify, document, and recommend fixes for issues we find. We do not implement code changes, and we do not guarantee any specific business outcome, conversion rate, or that every possible defect will be found. Testing reflects a professional, good-faith review within the scope agreed for the applicable plan.
2. Eligibility and client responsibilities
You represent and agree that:
- You own, operate, or otherwise have the legal right and authority to request testing of any website, application, or property you submit to us;
- Any account, staging environment, or test credentials you provide are provided lawfully and you have the right to grant us access to them for the purpose of performing the Services;
- The information you provide during intake and throughout the engagement is accurate and sufficient for us to perform the work; and
- You will not use the Services to test a property you do not have the right to test, or for any unlawful purpose.
3. Engagement process
Engagements begin with an intake submission describing your site, app, or software and the plan you are interested in. We confirm scope (pages, flows, or features covered) before testing begins. Turnaround times stated on our pricing page are estimates measured in business days from scope confirmation and access being granted, not from initial contact, and may vary based on the size and complexity of what is being tested. For the QA Partner subscription, each request should represent a single feature, flow, or fix; larger requests may be split into multiple requests or scheduled as part of the next monthly audit.
4. Service continuity
Outboard QA is operated by a single independent professional, and testing is performed by that person directly. In the unlikely event the founder is unable to continue an active engagement (for example due to illness or another unforeseen circumstance), we will notify you as soon as reasonably possible. For a one-time audit, you may choose a refund for any portion of the engagement not yet delivered, or a delayed completion once testing can resume. For the QA Partner subscription, an interrupted billing period will not be charged, or will be refunded on a prorated basis, and you may cancel at any time as described below. This section does not expand the commitments described in Section 3 or limit the disclaimers in Sections 11 and 12.
5. Fees and payment
Plans, pricing, and turnaround times are described on our website and are subject to change for future engagements; changes do not affect an engagement already confirmed. Engagements are currently arranged and invoiced manually after you submit an inquiry through our contact form. Once online payment is enabled, card payments will be processed by a third-party payment processor (currently planned: Stripe), and use of that payment method is additionally subject to that processor’s terms. We do not store your full payment card details ourselves.
6. Refunds
For one-time audits (Basic and Pro): if you cancel before testing has started, you will receive a full refund of any amount paid. Once testing has started, the engagement is non-refundable, because you are being billed for expert labor already performed, not solely for a finished report. If you believe a delivered report does not reflect the scope agreed for your plan, contact us through our contact form or at spinzone.creations@gmail.com and we will work with you in good faith to address it.
For the QA Partner subscription, fees already charged for the current billing period are non-refundable; see Cancellations below for how to stop future billing.
7. Cancellations
You may cancel the QA Partner subscription at any time by notifying us through our contact form or at spinzone.creations@gmail.com. Cancellation takes effect at the end of your current paid billing period; you will retain access to the Services through that period, and we do not prorate or refund the remainder of a billing period already paid for. There is no minimum term and no cancellation fee. A one-time audit that has already started, as described above, cannot be canceled for a refund.
8. Promotions
We do not currently run promotional offers or discount codes. If we do in the future, the specific terms of that promotion (eligibility, duration, and any restrictions) will be posted alongside the offer and will govern to the extent they conflict with these general Terms.
9. Confidentiality
We treat any non-public information about your business, product, or systems that we access in the course of testing as confidential, and will not disclose it to third parties except as needed to perform the Services or as required by law. Reciprocally, our internal testing methodology, checklists, and report templates are our proprietary confidential information, and are not licensed to you beyond your use of the deliverables described below.
10. Intellectual property
You retain all rights to your website, application, software, and content. We retain ownership of our testing methodology, templates, and any pre-existing tools or materials used to deliver the Services. Upon full payment, you receive a non-exclusive, perpetual license to use the audit report and its contents (findings, recordings, and user stories) internally for the purpose of maintaining and improving the product that was tested.
11. Disclaimers
The Services are provided on an “as is” and “as available” basis. We make no warranty, express or implied, that our testing will identify every defect or vulnerability present in your product, that fixing identified issues will produce any particular business result, or that the Services will be uninterrupted or error-free. To the maximum extent permitted by law, we disclaim all other warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, Spin Zone Creations LLC and its founder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to this website or the Services, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Services will not exceed the amount you actually paid us for the specific engagement giving rise to the claim in the six months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Spin Zone Creations LLC and its founder from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: your breach of these Terms; your lack of authority to request testing of a submitted property; or content, data, or access credentials you provide to us in connection with the Services.
14. Legal and export restrictions
You may not access or use the Services if you are located in, or a resident or national of, any country subject to a U.S. government embargo, or if you are listed on any U.S. government list of prohibited or restricted parties. You are responsible for compliance with any laws applicable to your own business, industry, and jurisdiction.
15. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Illinois. Before initiating a dispute or a payment-card chargeback, please contact us through our contact form or at spinzone.creations@gmail.com so we can try to resolve the issue directly.
16. General
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with any order or scope confirmation for a specific engagement, constitute the entire agreement between you and us regarding the Services.
17. Changes to these terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Changes apply prospectively and do not alter the terms of an engagement already confirmed.
